WARRANTY INFORMATION

All Visual Land inc. MP3 players are covered by a one-year factory warranty as follows:

Consumer Limited 1 Year Warranty

If your product does not work properly because of a defect in materials or workmanship, Visual Land, Inc. (hereinafter referred to as "Visual Land") will, for the length of 1 year, which starts with the date of original purchase ("Limited Warranty period"), at its option either (a) repair your product with new or refurbished parts, or (b) replace it with a new or a refurbished product. The decision to repair or replace will be made by Visual Land. A nominal handling fee does apply.

Conditions

This Limited Warranty ONLY COVERS failures due to defects in materials or workmanship, and DOES NOT COVER normal wear and tear or cosmetic damage. The Limited Warranty ALSO DOES NOT COVER damages of having been previously altered, modified, repaired or serviced by anyone other than the service facilities authorized by Visual Land to render such services, subject to accident, misuse, abuse or operated contrary to the instructions contained in the Owner's Manual, used for commercial purposes, or used as a rental unit at any time prior to or after original purchase at retail or damage that is attributable to acts of God. The opinion of Visual Land with respect to this matter shall be final.

You must mail-in your product during the Limited Warranty period. This warranty does not cover regular product maintenance such as cleaning. The Limited Warranty does not apply to any non-Visual Land hardware products or any software, even if packaged or sold with Visual Land hardware. This Limited Warranty only applies to products purchased in the United States, Canada or Mexico. This Limited Warranty is extended only to the original purchaser and only covers product purchased as new. A purchase receipt or other proof of the original purchase date is required for Limited Warranty Service.

THERE ARE NO EXPRESSED WARRANTIES EXCEPT AS LISTED UNDER "LIMITED WARRANTY COVERAGE". VISUAL LAND IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT, OR ARISING OUT OF ANY BREACH OF THIS LIMITED WARRANTY. (As examples, this excludes damages for lost time, travel to and from the servicer, loss of or damage to media or images, data or other memory or recorded content. The items listed are not exclusive, but are for illustration only.) ALL EXPRESSED AND IMPLIED WARRANTIES, INCLUDING THE LIMITED WARRANTY OF MERCHANTABILITY, ARE LIMITED TO THE PERIOD OF THE LIMITED WARRANTY.

THE INFORMATION OBTAINED FROM YOU MAY BE USED BY VISUAL LAND OR ITS AFFILIATED COMPANIES FOR THE PURPOSE OF DIRECT MAIL, INCLUDING PRODUCT INFORMATION AND/OR SPECIAL OFFERS.


All consumers that wish to take advantage of the one-year factory Warranty must contact Visual Land customer support (via our support page located here) in order to obtain an RMA (Return Merchandise Authorization) number and the address that the defective unit needs to be shipped back to. Players that are sent back without an RMA number are not the responsibility of Visual Land and are not covered by the warranty. The customer must ship the player back to Visual Land with the RMA number before any sort of exchange can be authorized. Visual Land is not responsible for any data, files, or music that was stored in the device. Upon proper authorization of the RMA it is up to Visual Land whether to exchange the player with a new one, or to repair the defective unit. If Visual Land no longer carries any particular model that is issued an RMA and Visual Land decides to replace the defective unit with a new one, Visual Land will then replace the defective unit with another model of equal or greater value.

The terms of this Warranty are subject to change without any prior notification. Any questions regarding the factory warranty should be addressed to Visual Land before any attempt to obtain an RMA.
